Are they legal to download? But if you own the game you download, and just wanted it as a backup or something would it still be illegal? To be honest, the emulator itself is not illegal. It's just software. The games you use on said emulator could be illegal. "Ahh,I'm gonna point out once again that the legal matters depend on the laws your country has and since the laws generally differ at each country you can't be certain of what is legitimate and what not.That's mainly for the posession of roms. If you own the console and the game, then they are legal. But that is the only case.

I'd imagine both the emulator and the emulator rom would both be illegal. As to make them you would have to do some form of reverse engineering of copyrighted material and hardware.

If it uses a rom dump from the console then it would be violating copyright law. Usually it is only the early versions of an emulator that relies on a rom dump from a console. But as the emu develops they rely on a rom dump less and less. As for game roms. They are all illegal even if you own the original game.

They're not just simply trying to prevent people from pirating the games and spreading them through the world freely, they're trying to prevent people from reverse engineer their games.
