Lets say a minor under 13 years of age signed up to your forum without parental consent and the parent then created a lawsuit against u, what would actually happen and what sort of punnishment would u be likly to get?
Just thinking about the responsibility of running a forum
Btw, i am aware that in some countries such as england the COPPA Laws don't have to be complied (I think...)

The COPPA Laws must be complied by all countries, as when registering on PB you're agreeing to abide by all US Federal Laws and California State Laws. So regardless of where you live, you're restricted by those laws on ProBoards. It's extremely unlikely anything would ever happen if a lawsuit were filed, at least to you the Forum Owner. If a lawsuit were to be filed then it'd be Patrick who would get the shaft, as it's on his servers that the information of the minor is being kept. Then, all he would have to do is plead that he never knew about it, and that he'll fix it by removing all the information from the servers. Nobody can really be held accountable when there's so many things to look out for. However, if you know somebody is under 13 delete them, as Patrick does have the TOS to keep himself and ProBoards safe from these sort of lawsuits.

thanks, no actually coppa laws don't have to be complied if ur server is in a country where they don't, england i believe was one of them, if i was running the site from my own server it would be in my house in england so it would have to comply to english not US laws

No matter what country you live in you must abide by the COPPA Laws when using ProBoards.

Right but since the boards are hosted here in the U.S. you do have to comply with COPPA despite what country you are in because the host is here in the U.S.

No legal action was taken when I lied about my age...yet someone knew what it really was I think you've missed the point slightly COPPA is designed to protect minors, and the potential lawsuit would come from the parents of a minor should anything bad happen to the child, not from Pat suing an 11 year old for ever penny of pocket money they had. I don't think I had any money Pat tried to sue me once. I sold him some bad kobe That good kobe woulda gotten me a mod position here, too!
