If a member claims they are saving data from your forum, do you just ban the at that point? You can't delete their system files if they claim to have an Excel sheet of birthdays and locations and then they blame it on a mental disorder they may or may not have. No one should have saving information from the forum on their personal pc. So I can ban to prevent it from happening again, but do nothing about what they say they have now?

Hi.
You wouldn't be able to do anything with regards to what they have saved on their personal computer.
You can ban and restrict access to your forum, which will limit what they have access to.

Is the data harvesting illegal, just against ToS or both? Data harvesting is a violation of our Terms of Service. Whether it is illegal or not you would need to consult with an attorney (or appropriate legal counsel).

Not like I have proof of what's on the pc, just their words.

Forums have the right to manage their membership which includes the right to accept, refuse, ban, and delete members (with or without a reason).
