I play an online role playing game and our fictional characters have an online forum that is hosted by proboards. My fictional character decided to use this symbol as his avatar. However, the forum moderator deleted it stating that the swastika breaks the proboards TOS. It was not based on her personal rules. She is just afraid of her forum being deleted because someone who dislikes my fictional character decides to use the swastika as a copout to get even with me. My arguement was that the swastika has been in existence for thousands of years and just because some Austrian Jew with a genocidal predilection used it for a decade or so does not make it an inherently racist symbol. I Am not promoting racism or even racial segregation in any way shape or form. My fictional character has absolutely nothing to do with anything racist. He's not even a human.

As a historic reference, I doubt it. If used as it was used in history, probably. If you're using it for a fictional character, I'd suggest creating a new image.

OK, but that doesn't tell me whether or not it breaks proboards TOS.
I do not intent to use that for an avatar for more than a week or so while my character is having his little debate on the RP forum. And the debate is NOT about promoting racism. I already had an avatar that I liked very much. Been using it for a long time. This tetra gammadion avatar is just a temporary thing.

Here is what I read in the TOS
3. CONTENT RESTRICTIONS
Your web site must conform to the following standards to be eligible to utilize this service:
1. User's content must comply in a manner consistent with any and all applicable laws of the State of California and the US Federal Government. 2. User's web site may not contain content promoting the use of illegal drugs, alcohol, sex, pornography, nudity, or any other form of adult content, profanity, hate, "spam," fraud, racism, mlm, pyramid schemes, or promote any illegal activity.
My understanding is that the swastika in and of itself does not promote racism. It is the context in which it is used that matters. Is that accurate?

That would be accurate, yes. You have to ask yourself if it is being used as a symbol of hate? If so, then it would be against the TOS.
However, you say that this is in someone's avatar? That would be seen without a reference to why it's being used?
