Hi,
I am using a custom theme by slip, but I am using a custom banner and not all the images but I DID give him credit in the footer and in the background it has a copyright by him. I know this could sound stupid, but I that's not technically ripping because I gave him credit right?

I think it may be best to ask the creator. I know some layout designers want you to use the skin as a whole, and not just the codes/some images. :]

Exactly my problem. I prefer custom template designs, but, designers are hard to find right now so I went with a pre-made.

Some designers do prefer you to keep most images, all but the banner, but the majority I think don't mind when you switch it up and have some of your own images and such. So long as the copyright is there if you're using their "theme/layout" or a main proportion of their skin.
It should be absolutely fine as it is with you crediting.
