Alright, I think I already know the answer to this, but I want to see what others think/know anyway.
The situation: Billy and Johnny both own perfectly legal copies of game X. For whatever reason, Billy's CD that came with game X is lost/stolen/broken/whatever, and he obviously can't use it anymore. He still has everything else that came with game X though (ie, CD key, game manual, box, etc). Can he use Johnny's CD, legally, if he uses his CD key still?
Would this be considered piracy?
I wouldn't think this would be illegal, as they both paid for the game. Neither of them is getting something they didn't pay for.
Your opinion?

It depends. If he lives on a boat with a black flag, and shouts "Yaaaarrrr" a lot, then yes he probably is a pirate.

I'd say it's legal...the company isn't losing any money if he's already paid for the game...a bit like how emulators say you can only download them if you have the actual console i suppose

No, most games have available (Via Support) a small disk replacement fee. (Usually around $10.00 and that uncludes shipping) And most game developers/publishers conisder the CD itself to be the legal proof of ownership... Now you might, might get away with that if you still had the original CD but it was damaged. Even then you would be using a copy of someone else's CD. Now if you had made a copy of your original CD then it would be alright. You are alowed to make 1 backup copy of your CD for just this sort of reason. If you do not have a backup of your CD then your only leal option is to contact the game publisher and get a replacement CD from them. Sure you can still use it. Some games don't require a CD though, and some have downloadable no-cd patches. Those patches are illegal. They are modifying the game to bypass a security feature.

We had a descussion about this on a popular UK magazine forum, the conclussion we came to (even the editor of the magazine agreed) was that it is legal to use another persons version of the game if you use your original cd key. If you copy the game itself thats when it becomes illegal

It is illegal to copy any CD, unless you are teh legal owner of that CD and you are KEEPING that copy! If you had the copy to ANYONE then it just changed from a legal backup to Piricy!

I would say the ONLY legal way is to contact the vendor/owner of the copyright. Terms can vary from creator to creator.
some games can be legally downloaded as a trial, and you get the full version by using a key which you pay for, so no cd needed (though you can ask for one if you need it).
